1. Agreement to Terms
By accessing or using the SmishAlert website, mobile application, and related services (collectively, the "Services") provided by SmishAlert LLC ("SmishAlert", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.
2. Description of Services
SmishAlert provides on-device and cloud-assisted message analysis to help identify and report suspicious or malicious content (e.g., smishing, phishing). Features include ML-driven filtering, threat classification, user reporting, and—for business plans—integrations with SIEM, SOAR, MDR, and similar tools.
3. Eligibility and Accounts
You must be at least 13 years old and have the legal capacity to enter into these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. Acceptable Use
You agree not to:
- Use the Services for any illegal or unauthorized purpose
- Circumvent or attempt to circumvent any security or access controls
- Resell, sublicense, or commercially exploit the Services except as permitted by your plan
- Use the Services to harm, harass, or defraud others
- Reverse engineer or attempt to extract source code or models (except as allowed by applicable law)
5. Subscriptions and Payments
Paid plans (e.g., SmishAlert Protection, business plans) are subject to the pricing and billing terms presented at the time of purchase. Subscriptions renew automatically unless canceled. Refunds are governed by the App Store terms or our stated policy at the time of purchase.
6. Intellectual Property
SmishAlert and its logos, designs, and technology are owned by SmishAlert LLC or its licensors. You receive only a limited, non-exclusive license to use the Services in accordance with these Terms.
7. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE DO NOT GUARANTEE THAT OUR DETECTION WILL CATCH ALL THREATS OR THAT IT WILL NOT OCCASIONALLY FLAG BENIGN CONTENT. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMISHALERT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless SmishAlert and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Services or violation of these Terms.
10. Changes
We may update these Terms from time to time. We will notify you of material changes via email, in-app notification, or on our website. Continued use after the effective date constitutes acceptance.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware, and you consent to personal jurisdiction there. (If your jurisdiction requires a different choice of law or venue, the foregoing may be adjusted to comply with mandatory consumer protection laws.)
